1. ACCEPTANCE OF TERMS
Welcome to GoodTherapy.org. GoodTherapy.org provides the GoodTherapy.org website ("Website") to you, the Member, subject to the following Terms of Service. By using our Website, you, ("Member"), agree to be bound by these Terms of Service. Please read them carefully. If you do not agree to these Terms of Service, do not apply to become a Member. You can review the most current version of the Terms of Service at any time at: https://www.goodtherapy.org/terms-service.html

Please note that GoodTherapy.org provides a public service to individual consumers who may access the GoodTherapy.org website (“Users”) for mental health information, to find a mental health provider listed in the GoodTherapy.org Therapist Directory (“Members”), or to seek inpatient or outpatient services from a Facility listed in the GoodTherapy.org Rehab and Treatment Center Directory (“Facilities”). These Terms of Service for Members apply only to Members, and not to Users or Facilities.

2. DESCRIPTION OF SERVICE AND BILLING TERMS

A. Member Access and Benefits
GoodTherapy.org provides Members with access to:

  • The GoodTherapy.org Therapist Directory where a qualified Member can create a listing to advertise their mental health practice to potential clients, consumers, and the general public. Qualified mental health practitioners are not required to complete their directory profile application nor advertise their practice in order to become a Member of GoodTherapy.org. Having a directory profile is optional for all Members who qualify.
  • GoodTherapy.org Network, a collection of health- and mental health-related therapist directories on other websites powered by GoodTherapy.org where a qualified Member can create a listing to advertise their mental health practice to potential clients, consumers, and the general public. Qualified mental health practitioners are not required to complete their directory profile application nor advertise their practice in the GoodTherapy.org Network. Having a directory profile in the GoodTherapy.org Network is optional for all members who qualify.
  • Opportunities to submit articles for publication consideration. 
  • Reduced-rate products and services from partners.

Premium Membership also includes access to:

  • Live continuing education web conferences and/or teleconferences.
  • Archived/recorded continuing education events.
  • Ability to submit professional events, workshops, and clinical groups facilitated or hosted by the Member to the GoodTherapy Workshop Directory to advertise to consumers.
  • Media Relations service.

Pro Membership also includes access to:

  • FrontDesk online appointment scheduling and option to add “Schedule Now” button to Member’s GoodTherapy.org directory profile listing.

B. Membership with GoodTherapy.org
Membership with GoodTherapy.org begins when a qualified mental health professional completes step three of the new Member registration process. Completion of step three is all that is required to become a Member and the attendant obligations of being a Member.

Immediately upon completion of step three of registration, a Member has access to their GoodTherapy.org Member’s Area, where they can access membership benefits.

In order to receive a directory listing and profile in the GoodTherapy.org Therapy Directory and in the GoodTherapy.org Network, a qualifying Member must meet the criteria for having a profile listing, complete all of the registration steps beyond step three, and have their profile approved by the GoodTherapy.org review team.

There are four Membership types: Basic Membership, Premium Membership, Pro Membership, and Group Membership. The membership fees are set forth on Step 3 of online registration and website payment form upon purchase, and Members may choose (1) a monthly subscription, (2) a discounted annual or multi-year subscription, paid upfront or (3) a discounted annual or multi-year subscription, paid on a monthly basis.

Members may adjust their Membership type by logging in to their Member’s Area and selecting and submitting the desired membership level (Basic, Premium, and Pro Membership) or calling the GoodTherapy.org Support Team at 888-563-2112 ext. 2.

Member agrees that Membership cannot be given away, sold, or willed. Membership terminates when Member cancels their membership or their membership is canceled by GoodTherapy.org.

Except in cases where Members elect an annual or multi-year subscription paid monthly, Members may temporarily suspend their membership for up to 30 days, 60 days, or 90 days one time in a 12-month rolling calendar year for whatever reason(s) by calling GoodTherapy.org at 888-563-2112 ext. 2. Member will be billed $4.95 per month while their account is suspended. A suspended account will automatically reactivate on the suspension end date and monthly billing will resume in accordance with Member’s original billing schedule. At that time, all of Member’s membership details and information will be restored and Member will be able to log in to their GoodTherapy.org Member’s Area to access their membership benefits.

Member acknowledges that the fee and Terms of Service for the GoodTherapy.org Membership are subject to change, and that GoodTherapy.org reserves the right to revise rates and terms under this contract at any time.

Members may cancel their membership to GoodTherapy.org at the end of their current subscription term without refund by calling GoodTherapy.org at 888-563-2112 ext. 2. The purpose of the call is to confirm identity and to gather helpful feedback; thus requests to cancel membership solely by email are not acceptable. If a Member cancels membership, they will not be charged after the current subscription term expires and any profile listing will then be removed immediately. Absolutely no refunds or prorated amounts will be given to Members or former Members who cancel before their term of service expires, regardless of their membership type. Absolutely no refunds or pro-rated amounts will be given to Members or former Members for any reason whatsoever.

C. Payment
Member authorizes GoodTherapy.org to automatically charge the membership fee to Member's credit card and/or via ACH payment during the course of membership. 

A Member will be billed $4.95/month for Membership while their account is suspended. A suspended account will automatically reactivate on the suspension end date selected by Member and the normal billing will resume.

Member acknowledges that GoodTherapy.org does not save or maintain any credit card or ACH payment information on the GoodTherapy.org server and instead uses First Data, Braintree, and/or PaySimple to store credit card information and process credit card or ACH transactions via a secure and encrypted SSL page to ensure the highest safety for all transactions.

If and when an existing Member's credit card or ACH payment declines for a periodic (Monthly, Annual, or Three-Year) membership fee, GoodTherapy.org's system will continue to attempt the transaction on a daily basis. GoodTherapy.org will make every effort to contact the Member should the Member's payment decline. GoodTherapy.org will charge a “return check fee” or “non-sufficient funds fee” of $25.00 if any check, other instrument, or electronic payment authorization you provide us in payment on your account is not honored upon first presentment for any reason, including if the payment is returned by drawee for “not sufficient funds.” If a Member's account is left unpaid, GoodTherapy.org will keep the Member's account active for up to 60 days from the time the Member's membership dues transaction first failed. Members will continue to be responsible for paying their past due amount and any future past due amount that accrues, up to 60 days past due. If a Member's account is left unpaid for more than 60 days, GoodTherapy.org reserves the right to hire a third-party collection agency to collect the Member's past due balance. When a Member's account goes to collections, GoodTherapy.org reserves the right to release all of the Member's membership information to the collection agency.

Member acknowledges that any monetary donation made by Member to the GoodTherapy.org GoodCause program is made directly through GoodTherapy.org and is not tax-deductible. Member authorizes GoodTherapy.org to charge the donated amount to Member's credit card and to deliver the donated amount to the selected GoodCause partner organization or company.

GoodTherapy.org may offer promotional codes (a “Promo Code”) from time to time. Member may only use a Promo Code once, and only one Promo Code may be used per Membership. Promo Codes have no cash value and are not valid for resale. The unauthorized modification, reproduction, resale, or trade of Promo Codes is strictly prohibited. GoodTherapy.org reserves the right to alter or limit its Promo Codes in its sole discretion. Member acknowledges that any discount applied to their account billing from a Promo Code will not last longer than one (1) year maximum. GoodTherapy.org has no liability for any problems or inability to use the Promo Code. 

D. Referral Benefits
There is an incentive offer extended to therapist Members who successfully refer a new member to GoodTherapy.org. Members can refer as many new members to GoodTherapy.org as wanted. Members can receive $100 via check from GoodTherapy for each new Member referred if the following referral qualifications are met:

  • The referred Member enters the referring Member's first and last name in the "which Member referred you" field during their registration. To receive a discount, the referred Member must enter your first and last name during their initial sign-up with GoodTherapy.org.
  • The referred Member remains a paying customer for at least 60 days if they pay annually or 120 days if they pay monthly.
  • The referring Member is still a paying customer at that time.
  • The referring Member provides GoodTherapy.org with their mailing address and a completed W-9 upon request.

Referral payments will be issued within 1 month after the deadline stated above and after receiving the required information from the Member.

Facility Members and Group Members are not eligible to a $100 payment for referrals; nonetheless we thank you for recommending GoodTherapy.org and any new Member referrals you may send to GoodTherapy.org.

E. Phone Tracking
GoodTherapy.org provides unique phone numbers to all GoodTherapy.org members located within the continental United States, Alaska, Hawaii, and Canada who have not opted-out of Phone Tracking. By default these phone numbers are published on member profile pages, search results, and other location-based landing pages. 

GoodTherapy.org provides a service to Users which permits the User to place calls to a Member with a unique phone number. In such an event the call is tracked on the Member’s performance metrics page, the call is transferred to the Member’s office phone number, and the member is sent an email confirming the call was made. This enables Members to credit GoodTherapy.org with phone referrals. Members can opt out of Phone Tracking by contacting the GoodTherapy.org support team. By becoming a Member of GoodTherapy.org, you authorize GoodTherapy.org to publish a unique phone number which will ring the phone number associated with your account. Any phone number found on GoodTherapy.org, may, by virtue of being published on a public domain, also be found on other websites, some which copy and reproduce content without GoodTherapy.org’s consent and some with GoodTherapy.org’s consent. Additionally, when a User contacts a GoodTherapy.org Member through the telephone number provided on the GoodTherapy.org website or on any GoodTherapy.org Network website, an email is transmitted to the Member email address.

F. User Emails
GoodTherapy.org provides a service to Users which permits Users to send specific Members email messages from web forms on the GoodTherapy.org website as well as those sites within the GoodTherapy.org Network. When a web-form email is completed by a User, the email is first screened to identify and remove possible spam or other content violating the GoodTherapy.org Terms of Service and Use. Emails which violate the Terms of Service and Use may not be forwarded to the Member. Emails which pass the screening will be forwarded to the Member at the email address provided by the Member.

Emails sent through the GoodTherapy.org system are tracked on the Member’s Profile Performance Metrics page. This enables Members to credit GoodTherapy.org with phone referrals. Members can opt out of the GoodTherapy.org email system by contacting the GoodTherapy.org Support Team.

Contact information and all other information provided in such emails are entered by the User and GoodTherapy.org cannot verify truth, accuracy, or completeness. 

G. Messaging
Members will be sent regular service announcements and/or administrative messages from GoodTherapy.org via email. These communications are considered part of GoodTherapy.org Membership, and Member will not be able to opt out of receiving them. Members who have not opted-out of the Phone Tracking will receive a confirmation email from GoodTherapy.org every time a User calls their unique phone number. This enables Members to credit GoodTherapy.org with phone referrals. In order to not receive these Phone Tracking emails a Member would need to opt out of Phone Tracking by contacting the GoodTherapy.org Support Team.

Former members of GoodTherapy.org may occasionally receive emails from GoodTherapy.org with offers to rejoin GoodTherapy.org, to attend special events, such as conferences or webinars, or with other information. Members of GoodTherapy.org authorize GoodTherapy.org to send these emails even after membership has been terminated. Former members of GoodTherapy.org may unsubscribe from future email correspondence by clicking on the unsubscribe link found in the footer of any email sent from GoodTherapy.org.

H. Web Conference/Teleconference Participation
GoodTherapy.org is not responsible for the content or comments made by any presenters, moderators, facilitators, or participants in any web conference or teleconference hosted by GoodTherapy.org. The opinions presented by presenters, moderators, hosts, or participants in any web conference or teleconference hosted by GoodTherapy.org are those solely of the individuals expressing such opinions and do not necessarily reflect the positions or opinions of GoodTherapy.org.

Participation in any web conference may require a Member to download software from a third party prior to participating in the web conference. GoodTherapy.org makes no warranty or representations concerning any third party software required to participate in any web conference, including that such software is compatible with any specific software or hardware utilized by any Member. Members are instructed to ensure that they download required software from official web conferencing providers, and to ensure that Member's individual computing devices meet specific software requirements and guidelines.

GoodTherapy.org makes no representation or warranty that participation by any Member in any web conference or teleconference will qualify for the continuing education requirements of any Member unless explicitly stated by GoodTherapy.org for such specific web conference or teleconference.

I. Performance Optimization Program (POP)
GoodTherapy.org may enter Member into the Performance Optimization Program (POP) upon Member's inquiry regarding dissatisfaction or cancellation of their membership, unless Member chooses not to enroll in the program. Member's qualification and entry into the program is solely at the discretion of GoodTherapy.org. Member may withdraw from the program at any time by calling GoodTherapy.org at 888-563-2112 ext. 2 and canceling their membership. At the end of the Performance Optimization Program period, if Member has not canceled membership, GoodTherapy.org will resume billing Member based on the Member's prior chosen membership level. 

The Performance Optimization Program provides the Member with:

  • 60-days of membership at the discounted rate of $9.95 per month.
  • Internal review of Member's profile which may include recommendation for changes and improvements to Member's profile and listing. If and when a Member does not make recommended changes to their profile, GoodTherapy.org may, in its sole discretion, make the recommended changes to the Member's profile and listing with or without notifying the member.
  • Featured placement of members listing on search results page and other landing pages.

Members who entered the Performance Optimization Program prior to February 15, 2019 may have received 60-days free membership upon enrollment into the Performance Optimization Program. At the end of the Performance Optimization Program period, if Member has not canceled membership, GoodTherapy.org will resume billing Member based on the Member's prior chosen membership level. 

GoodTherapy.org may, in its sole discretion, take additional unilateral actions to promote and improve the Member's profile and listing on the website.

J. Media Relations
GoodTherapy.org publishes relevant media relations opportunities for mental health professionals. These inquiries may come from GoodTherapy.org or third-party sites. Member responses to third-party inquiries are subject to the terms and conditions of use for such sites, and Member agrees that replying to these inquiries signifies assent to those terms and conditions.

K. Workshop Directory
The GoodTherapy.org Workshop Directory is a Premium Member benefit for Premium Members to list approved workshops, clinical supervision, consultation groups, continuing education, group therapy, retreats, and support group events they facilitate or host. Member can post a one-time event, or a recurring event. Decisions for event approval are at the discretion of the GoodTherapy.org team. We reserve the right to deny listing any event.

Requirements for listing in the workshop directory:

  • Event must be associated with the Member in some professional capacity; ex: the Member may be the presenter, creator, or the host of the event.
  • At least one of the presenters for an event, group, or workshop that is therapeutic in nature or providing clinical services must be a licensed professional in one of the fields that we require to list in the GoodTherapy Therapist Directory.
  • Events must be mental health/psychotherapy-related.
  • Events must be in line with GoodTherapy.org’s mission and vision.

Events listed by Member are not endorsed, sponsored, or approved by GoodTherapy.org. GoodTherapy.org’s continuing education sponsor approvals do not apply to events listed by Members.

L. FrontDesk
Pro Membership allows Member to register for and utilize the FrontDesk online appointment scheduler, powered by Therapy Partner, and add a “Schedule Now” button to Member’s directory profile listing. 

Member registration and utilization of FrontDesk is subject to the terms and conditions of use for TherapyPartner and Member agrees that utilizing FrontDesk signifies assent to those terms and conditions, here: https://app.therapypartner.com/tos

Members with Basic or Premium Membership may have signed up for FrontDesk with a 2-month free trial of FrontDesk. At the end of this free trial, Member will be billed $14.95 per month for FrontDesk (in a separate transaction to their GoodTherapy.org Membership fee), or Member may upgrade to a Pro Membership which includes FrontDesk. Member may cancel their subscription to FrontDesk by contacting the GoodTherapy.org support team at 888-563-2112 ext. 2. 

3. AGREEMENT
Member agrees that GoodTherapy.org is under no obligation to the Member except to provide the access and services described in Section 2, above.

A. Relationship between Member and Users
Upon receiving a call, email message, or other contact or query from a User, the decision to provide therapy or other services to that User, and the type and content of such services, is a matter for the professional judgment of the Member. Nothing in these Terms of Service or any other documentation published by or on behalf of GoodTherapy.org shall be construed to permit the Member to use any of the services provided to Members by GoodTherapy.org for purposes of or as part of therapy or health care services for any individual. Similarly, nothing in these Terms of Service or any other documentation published by or on behalf of GoodTherapy.org shall be construed as a requirement that Members must provide services to Users who initiate contact with a Member through GoodTherapy.org. Members of GoodTherapy.org understand that it is the Member’s responsibility to determine if he or she should provide services to any particular User seeking services and further understands that all assessment and treatment, or any other service, provides to any User of GoodTherapy.org, is done so independently and outside of GoodTherapy.org. Members of GoodTherapy.org understand that GoodTherapy.org provides advertising to Members and is in no way involved in the assessment or treatment provided by Members to Users or clients.

B. Disclaimer
GoodTherapy.org makes no representations or warranties of any kind, either expressed or implied with regard to our Website, its content, or its operations. To the fullest extent of the law, GoodTherapy.org disclaims all warranties, expressed or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

Member agrees that GoodTherapy.org has no liability of any kind whatsoever to the Member or to any individual, group, partnership, or corporation who may use the Service.

C. Assumption of Liability
Member agrees to assume all liability for directory profiles and all other listings published (including information, illustrations, files, images, claims, data, text, software, music, sound, photographs, graphics, video, messages, or other materials) including directory profiles and listings that GoodTherapy.org has edited ("Content"), and agrees to assume any and all responsibility for claims occurring therefrom against GoodTherapy.org.

D. Sharing of Personal Information
Member agrees that all personal information entered by the Member and stored by GoodTherapy.org may be transferred and shared in the event that GoodTherapy.org should be sold or given to another organization, corporation, or individual. Member shall not enter or store any personally identifiable information about any other User to GoodTherapy.org.  

E. Web Conferencing
GoodTherapy.org may offer access to free or fee-based continuing education "web conferences." "Web conference" refers to a live or archived audio and/or video presentation available on and accessible from GoodTherapy.org. All Members who participate in any web conference offered by GoodTherapy.org do so on a completely voluntary basis. GoodTherapy.org's provision of web conferences is based solely on GoodTherapy.org's discretion. It is GoodTherapy.org's intention to provide access to the web conference to all Members who have registered for a web conference. However, due to potential technical complications, presenter schedules and availability, Acts of God, or other unforeseen circumstances, registration for any web conference is in no way a guarantee of access or participation in the web conference.

F. Paid Event Registration Authorization
By registering for a paid event, Member authorizes GoodTherapy.org to charge Member's credit card the associated fee for the event. In the event that a scheduled fee-based web conference does not occur due to technical complications related to the GoodTherapy.org web conference platform, GoodTherapy.org will provide a refund of this fee to all registered Members or will reschedule the event. Members who are unable to access the web conference because of issues related to Member phone, internet, or personal computer issues are not eligible for refunds of fee-based web conferences. Additionally, refunds are given to Members who cancel their web conference registration at least two weeks prior to the event they registered for. Refunds are not given for purchasing an archived recording nor are refunds given to Members who are dissatisfied with a live or recorded web conference.

Through registration for access to a web conference provided by GoodTherapy.org, all Members agree and understand that GoodTherapy.org may contact said Members using the email address provided at the time of registration.

Web conferences available on GoodTherapy.org are provided on an as-is basis and are not intended to be, in any way, a substitute for professional advice, diagnosis, medical treatment, or psychotherapy. Always seek the advice of your physician or other qualified mental health provider with any questions you may have regarding any mental health symptom or medical condition. Never disregard professional psychological or medical advice, nor delay in seeking professional advice or treatment because of something you have read or seen on GoodTherapy.org. By attending a live web conference or viewing or listening to a recorded web conference, Member signifies assent to the terms and conditions contained in this Agreement.

G. Indemnification
Member agrees to indemnify, defend, and hold harmless GoodTherapy.org, LLC against any loss or liability resulting from Content, whether the Member's Content has been edited by GoodTherapy.org or not, including, but not limited to, any claims by third parties who may use Member's services.

Member agrees to indemnify, hold harmless, and defend GoodTherapy.org and its licensors, suppliers, officers, owners, managers, directors, employees, agents, affiliates, subsidiaries from and against any and all liability, loss, claim, damages, expense, or cost (including but not limited to attorneys' fees), incurred by or made against the Indemnified Parties in connection with any claim arising from or related to your use of the GoodTherapy.org website, the placement, posting, or transmission of any messages, information, content, or other materials on or through the GoodTherapy.org website by Member or users of Member's account, the editing, altering, or changing of Member's profile or listing (including text, content, grammar, and spelling changes) made by the GoodTherapy.org editorial team, or any breach or violation of these Terms of Service by Member or users of Member's account.

I. Intellectual Property Rights
Member understands that all trademarks and other claims of intellectual property rights, information, data, text, software, music, sound, photographs, graphics, video, messages, or other materials, whether publicly posted or privately transmitted, are the sole responsibility of the person from whom such Content originated. This means that you, the Member, and not GoodTherapy.org, are entirely responsible for all Content with your account at GoodTherapy.org, regardless of authorship or origination. GoodTherapy.org does not guarantee the accuracy, integrity, or quality of such Content. Member agrees to observe all statutes, ordinances, rules, and regulations with respect to the use of GoodTherapy.org and the intellectual property rights of all persons who may claim an interest in any Content. Under no circumstances will GoodTherapy.org be liable in any way for any Content whether or not GoodTherapy.org originated Content pursuant to any Writing Services, unapproved edits made to Members in Performance Optimization Program, or any other Service provided by GoodTherapy.org pursuant to Member's participation in the Website.

Member agrees GoodTherapy.org does not claim ownership of Content which you, the Member, submit or make available for inclusion on the Service. Additionally, GoodTherapy.org does not claim ownership of directory or profile or listing Content that GoodTherapy.org has edited, altered, or changed, either by a paid or free service. By submitting Content for inclusion on the Service, Member represents to GoodTherapy.org that with respect to such Content, Member is the owner of all brand names, logos, and trademarks, or the duly authorized representative or licensee of such owner, and will indemnify and save GoodTherapy.org free and harmless from any liability arising out of the use of such brand names, logos, and trademarks included in such Content.

Member grants GoodTherapy.org a perpetual, worldwide, irrevocable, royalty-free nonexclusive license to all Member Content posted on the site, including the right to distribute, display, transmit, store, edit, and create derivative works of such Content, such as within the GoodTherapy.org Network and other locations. Member expressly grants GoodTherapy.org the right to edit Member's Content and Member's profile for any reason, with or without notice, in GoodTherapy.org's sole discretion. This includes, without limitation, the right to remove content, the right to revise content, and/or the right to change or post any image on Member's profile.

Member agrees that any feedback, survey responses, suggested improvements, or ideas you provide to GoodTherapy thereto (together, “Feedback”) will become our property and may be used and published by us at our sole discretion, including for quality assurance and/or marketing or promotional purposes. To the extent you own any rights in the Feedback, you assign to us all right, title, and interest in and to such Feedback.

J. Member's Membership Duties, Obligations, and Limitations
Member agrees to provide true, accurate, current, and complete information about themselves and their mental health practice as prompted by the Service's sign up procedure and to maintain and update the Service's directory profile and listing data to keep it true, accurate, current, and complete.

Member agrees to notify GoodTherapy.org in writing or by email if Member’s professional license has been suspended, revoked or expired or if there has been any other change to Member’s credentials of licensing status. It is also the Member’s responsibility to keep their profile up to date with their correct license and credential information, including the type of license, license number, and the State or other jurisdiction in which the license is valid.

GoodTherapy.org Members have agreed through their acceptance of the Terms of Service for Members to remove any Verified Credential Seal they have published online if either their license or certification to practice is suspended, revoked or no longer valid for any reason OR if their GoodTherapy.org membership is canceled. 

Member agrees to use an email and secure password as part of the Service's registration process. Member is responsible for maintaining the confidentiality and security of the password and account and is fully responsible for all activities that occur under your password or account or membership. Member agrees to immediately notify GoodTherapy.org of any unauthorized use of your password or account or any other breach of security, and ensure that you exit from your account at the end of each session.

Member agrees that GoodTherapy.org has the right to suspend or terminate your membership and refuse any and all current or future use of the Service for any cause and without prior notice.

Member agrees that GoodTherapy.org reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, the Service (or any part thereof) with or without notice. Member agrees that GoodTherapy.org shall not be liable to Member or to any third party for any modification, suspension, or discontinuance of the Service.

Member agrees that GoodTherapy.org reserves the right to modify and update Member profile information, including, but not limited to, profile narrative, other text, insurance and contact information, and any other content that Member has submitted or not submitted, in an effort to increase accuracy, reduce spelling and grammar errors, eliminate content duplicated from other websites, improve the overall quality of the narrative, and to increase the number of potential referrals for Members. Member agrees that there is no guarantee that the changes GoodTherapy.org makes to profile narrative text content will achieve the above-mentioned objectives. GoodTherapy.org, at its discretion, may or may not provide notice to Members of any such edits. Member may edit their profile text narrative at their discretion, for any reason, at any time, via the GoodTherapy.org Member's Area.

Member agrees not to publish their profile narrative text content on other websites. Member understands that GoodTherapy.org reserves the right to "no-index" (hide from search engines) Member's profile Content if their Content contains a significant level of text that is duplicated or copied from other websites, and this determination is the sole-discretion of GoodTherapy.org.

Member agrees that GoodTherapy.org shall have the right, in its sole discretion, to promote the GoodTherapy.org Directory through various partnerships, promotional activities, advertising, and through direct use of the GoodTherapy.org Directory by selected partner websites and/or the GoodTherapy.org Network, which GoodTherapy.org deems useful, effective, and in the interest of GoodTherapy.org and its Members. Member agrees and understands that through these promotional relationships the Member profile can be displayed and hosted on other third party websites with whom GoodTherapy.org has a trusted relationship.

Member agrees that the Listing space provided to the Member will not be sublet to others, nor used for other purposes than herein named.

Member agrees that any links to third party sites are provided solely for convenience. Such sites are not under the control of GoodTherapy.org, and GoodTherapy.org is not responsible for their content, any changes or updates to them, or the collection of any personal data or information by the operators of such sites.

Member agrees that advertisers and sponsors are not related to GoodTherapy.org other than by a business relationship. Member's correspondence or business dealings with, or participation in promotions of, advertisers found on or through the Service, including payment and delivery of related goods or services, and any other terms, conditions, warranties, or representations associated with such dealings, are solely between Member and such advertiser. Member agrees that GoodTherapy.org shall not be responsible or liable for any loss or damage of any sort incurred as the result of any such dealings, products, or services or as the result of the presence of such advertisers on the Service.

Member agrees that responses to any media relations inquiries from third-party sites are subject to the terms and conditions of use for such sites, and that replying to those inquiries signifies assent to those terms and conditions.

Member agrees that this Terms of Service Agreement is periodically reviewed and updated as needed and that it is the Member's responsibility to stay abreast of these changes. Member is responsible for comporting their usage of the Services provided by GoodTherapy.org to the most current Terms of Service Agreement.

K. Electronic Communications
Member consents to receive communications from GoodTherapy.org electronically. GoodTherapy.org will communicate with you by email or by posting notices on this Website. Member agrees that all agreements, notices, disclosures, and other communications that GoodTherapy.org provides to Member electronically satisfy any legal requirement that such communications be in writing.

L. Prohibitions
Member agrees to not use the Service to:

  • upload, post, email, transmit, or otherwise make available any Content that is unlawful, harmful, threatening, abusive, harassing, tortuous, defamatory, vulgar, obscene, libelous, invasive of another's privacy, hateful, or racially, ethnically, or otherwise objectionable;
  • upload, post, email, transmit, or otherwise make available any Content that you do not have a right to make available under any law or under contractual or fiduciary relationships;
  • upload, post, email, transmit, or otherwise make available any Content that infringes any patent, trademark, trade secret, copyright or other proprietary rights of any party;
  • intentionally or unintentionally violate any applicable local, state, national, or international law;
  • create a competing website offering the same or substantially similar services to those provided through our Website or Service;
  • decompile, disassemble, or reverse engineer our Website, Service, and any related software found herein;
  • redistribute our Content in any manner, including, but not limited to, sale, license, lease, rental, subscription, or any other distribution mechanism;
  • provide or attempt to provide any therapy, health care or related services to any individual;
  • publish or distribute personal information about any other User.

M. HIPAA Compliance 
GoodTherapy.org is committed to ensuring compliance with the Health Insurance Portability and Accountability Act (HIPAA). To that end, we wish to clarify and reaffirm certain aspects of how GoodTherapy.org is compliant. More information about GoodTherapy.org’s policies regarding HIPAA Compliance can be found here.

  1. Personally identifiable health information is protected. 
    1. All personally identifiable health information about potential clients, clients, and other users must be kept off of any domain associated with GoodTherapy.org. If a Member obtains identifiable health information in connection with GoodTherapy.org services, it must be kept in accordance with HIPAA mandates, and the Member is solely responsible for ensuring this information is kept in compliance with HIPAA, including keeping that information encrypted or undertaking other security measures such as backups, disposal, storage, transmission, and integrity.
    2. Since GoodTherapy.org itself bans personally identifiable health information and does not provide any health care services itself, Members are not Business Associates under HIPAA and therefore any such agreements are not necessary. Instead, Members must comply with this Terms of Service for Members and Terms of Service and Use Agreement of GoodTherapy.org and comply with the strictures of HIPAA, HITECH, the Omnibus HIPAA requirements, and any other applicable federal, state, or local law, rule, or regulation that applies to the storage, handling, transmission, or other aspects of personally identifiable health information, especially in a medical or treatment context. GoodTherapy.org does not and will not verify that Members are in compliance with these rules and regulations because Members are not employed or contracted by GoodTherapy.org and operate outside of GoodTherapy.org’s control.
    3. Finally, Members agree that they will not link Goodtherapy.org with any personally identifiable health information, treatment information, or other data from potential or actual clients. Any information related to the provisioning of medical or mental health services shall be strictly kept off of GoodTherapy.org.
  2. Members do not provide medical or mental health services on or through GoodTherapy.org
    1. While Members do advertise on GoodTherapy.org and may discuss treatment or medical issues, specific treatment on or through GoodTherapy.org prohibited. Therefore, Members may only provide medical treatment out of their own offices, premises, digital platforms, or through any other method that does not involve GoodTherapy.org.
    2. Members may use GoodTherapy.org to obtain referrals to potential clients. The information they are provided must not be able to be correlated to personally identifiable information except by the provider (Member) of the services themselves. That provider (Member) must, therefore, comply with HIPAA and other regulations and rules.

N. Miscellaneous Legal Provisions
Member agrees that these Terms of Service, the Membership and placement and publication of information and content on the GoodTherapy.org website are governed by the laws of the State of Alaska, without regard to its conflict of law principles. Member agrees that the City of Anchorage, and the Municipality of Anchorage, in which GoodTherapy.org is located, shall be the forum for any legal action relating to our Website, Content, Service, and listings placed or published. Any cause of action by you with respect to our Website, Content, or Service, must be instituted within one (1) year after the cause of action arose or be forever waived and barred. Should any part of this Terms of Service be held invalid or unenforceable, that portion shall be construed consistent with applicable law and the remaining portions shall remain in full force and effect. To the extent that any Content is in conflict or inconsistent with this Terms of Service, this Terms of Service shall take precedence. The failure of GoodTherapy.org to enforce any provision or right of these Terms of Service will not constitute a waiver of such provision or right.

Member also acknowledges the existence of the Terms of Service and Use Agreement which outlines the service and use conditions applicable to all Users of GoodTherapy.org and agrees, by virtue of visiting GoodTherapy.org, to all of the conditions contained in the Terms of Service and Use Agreement.

These Terms of Service constitute the entire agreement between the parties with respect to the subject matter hereof and supersedes and replaces all prior or contemporaneous understandings or agreements, written or oral, regarding such subject matter.
