For mental health professionals, getting a subpoena or a call from an attorney can be anxiety provoking. However, therapists have “super powers” that can be used as strengths in court. These skills can help therapists while they are on the stand and to develop more confidence when interacting with the legal system.
In this 2-hour continuing education web conference, Nicol Stolar-Peterson, LCSW will explain how to create a court policy that sets limitations and guidelines for all court-related requests a mental health professional might receive. Nicol will discuss “safe” ways for clinicians to respond to subpoenas and attorneys. She will also describe the dos and don’ts of court letters and clarify what should and should not be included.
In addition, Nicol will discuss the types of witnesses clinicians may serve as within their professional scope. Nicol will outline suggestions for avoiding pitfalls in a deposition or on the stand. She will also discuss the difference between direct examination and cross examination.

Nicol Stolar-Peterson, LCSW, BCD has over 20 years experience working with children and families. She worked for Child Protective Services for over 11 years as a child abuse investigator, forensic interviewer, and adoptions social worker. Nicol was licensed in 2009 and began her work as a child custody evaluator shortly thereafter and became a Board-Certified Diplomat of Clinical Social Work in 2015.
Nicol serves as an expert witness and her areas of expertise include child abuse, sexual abuse, child protective services, and child custody. Nicol coaches colleagues on court-related matters and consults with attorneys on a regular basis. She is also contracted as an expert to the Board of Behavioral Sciences (BBS).
Nicol’s practice is located in Murrieta, CA. Nicol is also the founder and director of Kids Court & Counseling Center, a non-profit that helps children prepare for court testimony and appearances if they are victims of crimes, witnesses to crimes, in foster care, and/or going through a litigious custody battle where testimony occurs.
